As this proposal stands the Division would object to this application on the grounds that the proposed extension will restrict access and could have a detrimental affect on the public sewer. The Division is concerned about the route of this sewer (please see attached plan) and discussions have been entered into with the applicant and their agent to reduce the size of the proposed extension. Therefore the Drainage Division of the Department of Transport requests that any decision on this planning application be deferred until such time as a amended plan has been received. The Division will contact the Planning Committee with its formal comments as soon as this information is at hand.

### Officer's Report

The proposal is set to the rear of the property. The conservatory is not visible from the street scene. I do not feel the proposal will cause any significant harm to the visual amenities of the street scene.

In respect of the impact on No.14, the proposal is set to the north west of the neighbouring property. The proposal will be set off the boundary by approximately 400mm. The conservatory will project 1m beyond the rear building line of the neighbouring properties single storey structure. I therefore do not consider the proposal will cause any significant harm to the occupiers of No.21 from overlooking or overshadowing.

Impact on No.12 Slieau Whallian, the application site is set to the south east of the neighbouring property. The proposed conservatory will abut the boundary of the neighbouring property. The conservatory will project 3m beyond the rear building line of the neighbouring property. The nearest habitable window is set 2m off the boundary. The conservatory will be set on the north east facing elevation of the property. Due to the orientation of the site, I do not consider the proposal will I will cause any significant harm to the occupiers of No.12 from overshadowing or loss of light. The applicant has indicated that the side elevation of the conservatory will be obscure glazed so as to cause any impact from overlooking to the occupiers of the neighbouring property.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of a rear conservatory as shown in drawing numbers 00436/1 date stamped 14th March 2006 and 00436/2 Rev A date stamped 29th June 2006.

C 3. The windows to be formed in the north-west and south-east facing elevations of the conservatory shall only be glazed or re-glazed with obscure glass.

C 4. No facing materials shall be used other than materials similar to those used on the existing building

C 5. There must be no discharge of surface water to the main foul sewer.

The Drainage Division advises that the surface water from the proposed development is to be discharged to the "existing drainage". If this "existing drainage" discharges (directly or indirectly) to the foul sewerage system then it should be noted that an alternative means of surface water disposal must be provided.

The Drainage Division advises you that a public sewer crosses this site. The line of the sewer(s) must be identified before development work commences. The sewer(s) must be fully protected whilst all building works are being carried out. No part of the proposed development may be constructed nor any trees planted, within two metres of any public sewer either at the time of construction or at any time in the future.
