## Officer's Report

### Site

The dwelling Loraldene, Tromode Park, Douglas, is a detached bungalow located on the eastern side of Tromode Park and west of Ballanard Road.

The side boundary, which is shared with the neighbouring property Taormina, consists mainly of a hedgerow runnin along the entire side boundary and varies in height from 2 to 3.5 metres, as well as a 1.8 metre high timber fence. The boundary to the rear comprises of a 3 metre high timber fence.

The neighbouring property Taormina has a single obscure glazed window on its side elevation (south).

### Land Use Zoning

The property has been zoned under the Douglas Local Plan order 1998 as being predominately residential use; the site is not within a Conservation Area

### Planning History

The property has benefited from two recent Planning Approvals:-

Approval in principle for the erection of a self contained granny flat extension to side of dwelling (03/00840/A)

### Proposal

The application is a Retrospective application for amendments to approved granny flat extension to side elevation (04/00173B).

The first alteration is the reduction of the width of the approved extension by 0.79 metres to give an adequate gap to the side boundary and provide access to the rear.

The second alteration is to install an obscure glazed, top opening kitchen window to the side elevation of the extension. This window is proposed to provide the kitchen with natural light and ventilation.

The third change is the removal of the rear bedroom window within the extension and replace it with a patio door giving access from the bedroom to the rear garden.

### Representations

The Chief Fire Officer has recommended that mains wired, interconnected smoke detectors are installed.

A single letter of objection has been received from the neighbours of Taormina. They have objected with regard to the side window as being unnecessary, will be detrimental to privacy and living experience and adding yet further impact to their property.

The patio door they suggest is inappropriate and unnecessary for the purported need and that there is more than adequate access both front and back which might be suitably adapted. The representation also remarks as to the total absence of consideration for mobility issues in the design and the dimensions of the granny flat.

### Assessment/Recommendations

The installation of a side obscure glazed window in its location would be acceptable. In considering the privacy issues with regard to the neighbouring property Taormina, the window proposed is obscure glazed and there is a two metre high hedge along the side boundary, this satisfactorily mitigates the issue.

The rear patio door which has replaced an approved rear window is a very minor alteration and one which does not cause any adverse impacts to the detriment of the neighbouring properties and therefore would seem to be acceptable.

The reduction of the width of the extension would also seem reasonable and will retain access via a side passage way to the rear of the property for all users.

For these reasons the proposal would seem to be acceptable in this location and therefore my recommendation is for approval.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the submitted documents and drawings 1.7063-101-00, 1.7063-201-00 and M/4/04 all received on 19th January 2006.

C 3. Obscure glazing (Grade 5) shall be installed in the north elevation of the kitchen window and shall be kept and maintained thereafter.

C 4. The proposed granny flat extension may be used only in association with "Loraldene" and for purposes ancillary to the use of "Loraldene" as a single dwelling house.

N 1. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
