## Officer's Report

The proposal is to provide a coffee shop within the existing gym complex off the Mooragh Promenade. The applicants are proposing to sell tea coffee and healthy pre-packed snack and then in the future the applicants wish to sell hot and cold food prepared on the premises. The selling of the hot and cold food is not part of this proposal.

The properties above the gym are in residential use. The opening hours are broadly in line with the opening hours of the gym. The coffee shop would be complementary use to the existing facility. I do not consider the proposal will intensify the use of the complex to an unacceptable level to impact on the residential properties above the complex.

Mooragh Promenade is un-restricted in parking term in the vicinity of the area and is sufficient to accommodate any increase in number of vehicles staying in the area for a longer period of time. Furthermore, the restricted food and drink being provide would limit how long patrons will stay in the area. I therefore do not consider the proposal will be prejudicial to the free flow of traffic using the Promenade.

The proposed outdoor seating facility is a relative minor element. I do not consider the proposal will cause any significant disturbance to the neighbouring residential flat above the proposed seating area. On balance I feel the proposal is acceptable.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the additional use of providing refreshments as shown on drawing numbers 00479/1, GE1021 and letter from the The Gym Ltd date stamped 21st March 2006.

C 3. The premises shall at no time be used for the preparation and sale of hot food for consumption on or off the premises.

C 4. Those areas shown as seating areas on the approved plans shall only be used for the consumption of food and drink and that no other part of the building shall be used for such purposes.

C 5. No food or drink shall be sold to members of the public other than to patrons of the Gym facility or their guests.

C 6. Customers shall not be sold any food or drink outside the hours of 8am - 6pm Monday to Friday, 10am -3am Saturday and 10am -1pm Sunday

N . PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.
