In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 8 June 2006, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This permission relates to the additional use of providing refreshments as shown on drawing numbers 00479/1, GE1021 and letter from the The Gym Ltd date stamped 21st March 2006.

3. The premises shall at no time be used for the preparation and sale of hot food for consumption on or off the premises.

4. Those areas shown as seating areas on the approved plans shall only be used for the consumption of food and drink and that no other part of the building shall be used for such purposes.

5. No food or drink shall be sold to members of the public other than to patrons of the Gym facility or their guests.

6. Customers shall not be sold any food or drink outside the hours of 8am - 6pm Monday to Friday, 10am -3am Saturday and 10am -1pm Sunday

NOTE PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

You should note that a copy of the Officer's report which led to the decision being made, along with any correspondence relative to the application, is available for inspection at the Department.

The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.
