# Refusal Decision Notice

## Town and Country Planning Act 1999

### Town and Country (Development Procedure) Order 2005

Samson Designs
Mr S T Samson
The Workshop
Park Road
Port St Mary

In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **REFUSE** the following application made on behalf of:

**Name:** Mr D Newton
**Proposal:** Refurbishments and alterations to form five executive apartments at:
Marine House
Falcon Hill
Port Erin
Isle Of Man
IM9 6HG

which was considered on 27 June 2006, for the reasons set out below.

**Date of Issue:** 10th July, 2006

Murray House
Mount Havelock
Douglas

### Reasons For Refusal:

1. Whilst the renovation and use of the building is encouraged, the proposal would create so many apartments as could cause an adverse impact on the neighbourhood through the need for parking spaces which cannot be provided on site. This recommendation is without prejudice to a further proposal for the conversion of the building to two apartments, one on each floor.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
