### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This permission relates to the installation of extraction equipment and fencing as shown in the layout drawing received on 12th July, 2006 and the elevation and location plans received on 23rd January, 2006.
3. The rating level of the noise emitting from the fan and associated ducting shall not exceed LAeq, 1 hour - 40dB daytime ( 0700 - 2300) and LAeq, 5 minute - 30 dB night time ( 2300 - 0700) as measured at the facade of any window of 18 and 18A, Michael Street.

The rating level shall be measured and calculated in accordance with BS 4142:1997.

4. Odour control must be introduced such that fine filtration or ESP followed by carbon filtration (carbon filters rated with a 0.2 - 0.4 second residence time) is achieved or fine filtration or ESP (electrostatic precipitator) followed by UV ozone system.

5. The proposed fans may not be operational between 2300hrs and 0700hrs in any 24 hour period.

Note: the applicant has indicated that the premises are not intended to be operational any later than 2300hrs on any evening and it is suggested by the Environmental Protection Unit that the noise abatement is unlikely to be able to achieve the recommended noise level control in the 2300 - 0700hrs period.

6. The timber trellis shown in the approved drawings must be erected prior to the installation of any of the proposed equipment or ducting.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

You should note that a copy of the Officer's report which led to the decision being made, along with any correspondence relative to the application, is available for inspection at the Department.

The proposed development must not be commenced until either:

- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.
