### 1.1 Rowdy Behaviour

During the period 13 Jan 06 – 31 Jan 06 the residents of Northview were able to produce records and monitoring (from a Matron tape recording system provided to them by the EPU) of only two incidents of alleged noise nuisance from rowdy behaviour lasting for less than 5 minutes each. Although maximum noise levels were sufficiently loud to cause sleep disturbance the frequency and duration of these events are insufficient for the EPU to consider this noise as likely to constitute a statutory noise nuisance from this evidence.

### 1.2 Fan Noise

The residents of Northview did not indicate on their record sheets that noise from the fans continued to be a nuisance to them and indeed analysis of noise monitoring indicates that the level of noise from the fan was below the EPU's recommended noise limit criteria.

To prevent noise nuisance from low frequency noise the following criteria are recommended in accordance with research recently commissioned by DEFRA in the UK:

### 2. Recommendations

If it were determined that planning permission was required the following condition is recommended with the objectives:

i. Broadband noise from the ventilation system is no louder than the existing background noise levels.
ii. Any audible low frequency tonal noise is below the low frequency noise disturbance criteria as currently proposed by the Department of Environment, Food and Rural Affairs (DEFRA).

### Recommended Noise Conditions

1. The broadband level of the noise emitted from the mechanical ventilation system at the Mandarin Takeaway shall not exceed LAeq, 1 hour - 30 dB daytime (0700 - 2300) and LAeq, 5 minute - 25 dB night-time (2300 - 0700). This shall be measured inside any adjacent residential premises.
2. Low frequency audible tonal noise emitted from the mechanical ventilation system at the Mandarin Takeaway shall not exceed the following criteria measured inside any adjacent residential premises:

#### 2.1 Between the hours of 2300 - 0700 hrs measured as 1/3 octave Lleq, 5 min²

## 3. Instrumentation

There was no significant drift (less than 0.1 dB) in the calibration tone between the beginning and end of DAT tape recording. [Table omitted in markdown export] CAF – Accredited Calibration 20 September 2005 The sound level meter complies with the IEC 1672 Class 1 standard. [Table omitted in markdown export] There was no significant drift in calibration before and after noise measurements were taken.

N.B. 25 dB Background Noise + 25 dB Fan Noise = 28 dB Total
38.3 dB - 19.1 dB A-weighted correction @ 100 Hz 1/3 Octave = 19.2 dB(A)
Hence noise from fan is less than 25 dB(A) Broadband.
