In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

which was considered on 25 May 2006, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This permission relates to the erection of two buildings together with landscaping, access and car parking all to replace the existing Imperial Hotel, all as shown in drawings reference SC783/P/10-03, -10-04, -12-04 and -12-05 received on 27th January, 2006, SC783/C/10-01A, -10-02A and -12-03A received on 21st February, 2006, SC783/C/10-01B, SC783/P/11-01 and -12-02B, all received on 23rd March, 2006 and SC783/P/12-01B received on 3rd April, 2006.

3. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the

completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.

4. Prior to the commencement of works on site samples of:

a) the roofing material, which must be slate or a high quality imitation thereof;
b) the window opening styles and frame sections; and
c) the material and sectional details of the balcony railings and supporting columns

must be approved by the Planning Authority.

5. Prior to the occupation of any of the apartments, the parking spaces associated with each apartment must be set out as shown in the approved plans and be available for use.

NOTE PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.

NOTE For water connections that comprise more than a single connection to a water main or service, or where new water mains and hydrants will be required, the applicant should contact the Isle of Man Water Authority Planning and Projects Section, telephone 695958.

NOTE The Applicant's attention is drawn to the recommendations of the Disability Access Officer, a copy of which is attached to this notice.

NOTE The proposed flats must, on completion of the proposed works, comply with the requirements of the Housing (Flats) Regulations 1982 and be registered thereafter under the same Regulations.

NOTE The applicant is advised that there is to be an International Viola competition taking place in the adjacent Ocean Castle Hotel between 16th and 20th August, 2006 inclusive and that any works to be carried out on the proposed development should not interfere with this event. In addition, the applicant should bear in mind whilst undertaking any of the proposed works that the site lies adjacent to existing residential property and tourist accommodation and the works should minimise any disruption or inconvenience to these properties.

NOTE The applicant should retain the services of a suitably qualified engineer in respect of the design and overseeing of the works required to be undertaken adjacent to the boundaries of the site.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

You should note that a copy of the Officer’s report which led to the decision being made, along with any correspondence relative to the application, is available for inspection at the Department.

The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.
