### Site description

The site represents a small piece of land, approximately 10m by 7m opposite the Town Hall in Port St. Mary on the Promenade. The site used to accommodate shops with living accommodation above prior to the buildings being demolished.

### Planning Status

The site is within an area designated as Existing Predominantly Tourist Accommodation on the Isle of Man Planning Scheme (Development Plan) Order 1982 and Mixed Use (Residential/Retail/Tourism/Industry and Offices) on the emerging Port St. Mary Plan (although this is not likely to emerge further than the public inquiry which was held in 2001).

### Planning History

Previously, a planning application was submitted in respect of the site along with the land to the north east. PA 04/0389 was refused for the principle of the erection of (four) replacement dwellings. The refusal, confirmed on appeal, related to over-development of the site. Whilst the Inspector accepted that only limited amenity and car parking space was to be provided and included these as reasons for refusal, the Minister disagreed with this and reduced the reasons for refusal to be concerned only with over-development. The indicative plan at that time showed a four storey building occupying all of the site except for small yards at the rear.

After this, PA 05/0558 proposed the principle of a four storey building on half of the site with roughly the same footprint. The indicative drawing showed a building which was a little over 11m in height: that proposed previously was 15m in height and did not include integral garaging as this later one did. The floor layout showed that the building would be sub-divided into one four bedroomed house: previously the scheme was for four dwellings. In essence the new scheme proposed a quarter as many dwellings but with a building with occupied almost the same footprint over half the site, but was 4m lower.

This application was approved.

Also, a subsequent application for the other half of the site, PA 05/1265, proposed the erection of two apartments within the new building proposed on that part of the site with no parking. This application was approved.

### Proposed development

This latest proposal involves the same building but used for two apartments, each with two bedrooms and spread over two floors and with two garage doors servicing integral garages. This new building complements that approved on the other half of the site and represents good use of a presently unused site which would benefit from development.

### Representations

There are representations from Port St. Mary Commissioners who raise no objection, Fire Prevention Officer and Isle of Man Water Authority who raised no objections subject to the inclusion of standard notes and from a resident of Port Soderick who supports the application. There is an objection from the Society for the Preservation of the Manx Countryside and Environment who objected previously on the basis of over-development of the site and maintain this view despite recent approvals for this massing and use of the development.

The Commissioners, Fire Prevention Officer and Isle of Man Water Authority should be afforded interested party status as they are statutory consultees or undertakers. The Society for the Preservation of the Manx Countryside and Environment and the resident of Port Soderick are not directly affected by the proposal and should not be afforded such status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of a building accommodating two apartments and associated garaging, as shown in drawings AT 773.1 and -.2 both received on 2nd December, 2005.

N 1. For water connections that comprise more than a single connection to a water main or service, or where new water mains and hydrants will be required, the applicant should contact the Isle of Man Water Authority Planning and Projects Section, telephone 695958.

N 2. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.
