In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

### Reasons For Refusal:

1. The proposed creation of a holiday village in this location is tantamount to the creation of eleven new residential dwellings with terraced area and other residential paraphernalia in the countryside which would be contrary to the Isle of Man Planning Scheme (Development Plan) Order 1982 and Policies GP3, EP1, EP3, EP6, EP7, EP21, BP9, BP12 and TP4 of the emerging Strategic Plan in that the proposed development is:
(a) located within an area of high landscape value and scenic significance;

(b) adjacent to a proposed National Heritage Area and a Nature Conservation Zone;
(c) is not zoned for residential development; and
(d) its residential development is contrary to the provisions of Planning Circular 1/88.

Furthermore, no evidence has been submitted to demonstrate the development would not have any environmental and/or traffic implications on the locality. This proposed development would be located in an unsustainable location and would not maintain or enhance the character or quality of the surrounding landscape.

2. The proposed conversion of the existing building into five holiday apartments and the partial restoration of a ruined tholtan would be contrary to Circular 3/89 which clearly outlines the Department's policy for the renovation and continued use of buildings of merit which contribute positively to the character of the countryside. The buildings do not have any positive merit within the character of the countryside and their redevelopment would be contrary to Planning Circular 3/89.

Furthermore, the applicant has not demonstrated that the buildings in question are capable of renovation and no evidence has been submitted to demonstrate the barn is redundant from its original use, as required by Planning Circular 3/89.

3. This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.

- the time for requesting an appeal in relation to any decision at review has expired; or
- any appeal has been completed.

Note 2: Rights of appeal against the decision of the planning committee are attached.

### Reasons For Refusal:

1.
