The planning application seeks approval for the erection of a grain drying shed and an associated agricultural fuel bund and hazardous chemicals store within the holding of Ballamillaghyn Farm in Braddan. It is understood that the previous grain dryer was lost in a fire on the farm.

In terms of planning history, the farm and its overall holding has been the subject of a number of previous planning applications, several of which relate to the operation and maintenance of aircraft from site. The most recent of these previous planning applications 04/2526/A, which sought approval in principle for the construction of two concrete runways and the erection of an aircraft maintenance facility, was refused. Ballamillaghyn Farm has been the subject of enforcement action and legal prosecution in relation to aircraft related activities from the site. The fuel bund and hazardous chemicals store is proposed on part of the site that has approval through PA 03/1410/B for the formation of a farm equipment assembly area. The proposed grain drying shed is proposed on a site adjacent to existing farm buildings.

In terms of representations to the planning application comments have been received from Braddan Parish Commissioner, the Department of Transport’s Highways Division, the SPMCE and the Fire Safety Officer. Braddan Parish Commissioners have recommended that the planning application be approved. The Department of Transport’s Highways Division has advised that they consider there to be no adverse traffic impacts arising from the proposed development. SPMCE have advised that they are concerned about the proposed development and in particular the siting of the fuel and hazardous chemical store next to a public footpath. The Fire Safety Officer has made no comment on the merits of the planning application but requested that, if approved, the applicant is advised to contact them to discuss the provision of appropriate fire precautions.

In terms of the assessment of the planning application, I would suggest that the proposed development seems to be accordance with the type of activity and level of operation to be expected to be found in a farm holding on this size. Whilst I can understand the concerns of the SPMCE in relation to the public footpath it seems sensible to site the store away from other farm buildings and the chances of members of the public being affected are slight. I recommend that the planning application be approved. Whilst the farm is an operational agricultural unit and I have no reason to suspect to that the proposed development is related to the operation or maintenance of aircraft it is probably prudent to condition the use of facilities proposed, and in particular the fuel bund and hazardous chemicals store, by this planning application as agricultural and to exclude aviation related activities.

C 1.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2.

This approval relates to the erection of a grain drying shed and an agricultural fuel bund and hazardous chemicals store as shown on drawing no.s TS001 and TS003 date stamped the 31st October 2005.

C 3.

The agricultural fuel bund and hazardous chemicals store may only be used for the storage of materials in association with the agricultural operation of Ballamillaghyn Farm. No approval is hereby implied to the use for any other purposes, including the storage of aviation fuel.

N 1.

The applicant is advised to contact the Fire Safety Officer to discuss the provision of appropriate fire precaution measures and access arrangements for fire appliances.
