In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 17 March 2006, for the reasons set out below.

### Reasons For Refusal:

1. There is no evidence submitted to demonstrate that the stone barn is structurally capable of renovation and no evidence has been submitted to demonstrate the barn is redundant from its original use. This is contrary to Planning Circular 3/89 and therefore it would be premature to determine this application without this evidence.

2. The use of the proposed access road would by reason of its close proximity to the existing dwelling of Ballacoraige Cottage and other adjoining properties be detrimental to the residential amenity of the occupiers of those properties.

3. The existing access out Cronk Road does not provide adequate visibility for vehicles leaving the site and therefore would be prejudicial to highway safety.

4. This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.
