In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 7 October 2005, for the reasons set out below.

### Reasons For Refusal:

1. The site is not designated for development on the Isle of Man Planning Scheme (Development Plan) Order 1982. The creation of a dwelling as proposed would be contrary to the provisions of this Order and to the provisions of Planning Circulars 1/88 - Residential Development - Houses in the Countryside and 3/89 - Renovation of Buildings in the Countryside. The existing building is not eligible for conversion to a dwelling under the provisions of 3/89 and in any case is being absorbed into a completely new dwelling.

Note: there is no supporting information provided with this application to explain why an exception to the Department's general policies against development in the countryside should be set aside in this case. In addition, despite the inclusion of a question in the application form, no reference is made to any previous planning applications which have been submitted for this site, including one which specifically refers to this part of the site. PA 98/1087 proposed, amongst other things, the conversion of the tractor house to residential use and was refused.

2. This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
