The application site situated on the northern side of the Main Road (A3) located approximately 500m east of Ballaugh. The site is situated within an area not zoned for development and an area of high landscape value and scenic significance.

The proposal is to create a 8m wide vehicular access to the site to allow access to the site and to retain an 1.5m pathway from the existing garden to the site.

The issue to bear in mind is the site has been changed from agricultural land to residential land. This application is not seeking an approval for the continued use of the land as residential land. The proposed vehicular access will allow vehicles to be parked within the site. However, the applicant has already got a vehicular crossover to his property situated approximately 16m to the west of the proposed access. This proposal would further intensify the unauthorised use of the land, as residential land, and furthermore there is no justified need for a vehicular access off the Main Road to serve the site.

The applicant has also broken through an existing sodbank to gain access to the site. The breakthrough has allowed the adjacent site to be used as a garden. I have no objection to the breakthrough if the site were used as agricultural land. In term of the impact of the breakthrough on the visual amenities, the proposal is mainly obscured from the public highway. I feel the breakthrough has a neutral affect on the visual qualities of the locality.

I therefore consider the creation of a vehicular access and continued use of the pathway to the site would intensify the unauthorised use of the site as residential land and would represent an unwarranted intrusion into the countryside. The applicant has not demonstrated that there is sufficient need to justify the creation of an additional vehicular access in this location and has not demonstrated that there is sufficient need to justify an encroachment into agricultural land.
