In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 16 September 2005, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This permission relates to the demolition and development works shown in drawings 300 to 316 inclusive and 05 and 06 all received on 21st July, 2005.

3. This approval relates to the entire scheme as shown in the submitted plans including development on land which is not yet in the full control or ownership of

the applicant. The development must be undertaken exactly as shown in the approved plans including the provision of the gardens to units 4 and 5 and the communal garden alongside. If any part of the site is not obtainable then the individual components which can and are to be undertaken must be the subject of a further application which demonstrates how they may be undertaken independent of other elements in the overall approved scheme.

4. No approval is hereby granted to the large rooflight shown on the western end of the north facing pitch of the building on the coalyard site until such times as the Planning Authority is provided with larger scale details of this element and the adjoining rooflights and is satisfied that such are appropriate for the Conservation Area.

5. All windows must be installed as shown in the approved drawings and retained as such in perpetuity unless otherwise authorised by the Planning Authority. Details of the section and material of the windows and doors, including the garage doors, must be approved by the Planning Authority prior to the installation of the same.

6. Prior to the occupation of the apartments, the parking spaces shown on the drawing must be available for use and retained for such thereafter.

7. The proposed parking spaces may be used only by the occupants of, and visitors to the proposed apartments.

8. No development on the new buildings shall take place within the area identified as the site until the applicant or their agents, or successors in title have secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been approved by the Planning Authority. The scheme should include a timetable for the investigation and the applicant is encouraged to consult Manx National Heritage prior to the submission of such a scheme.

NOTE The applicant is advised to consult the Water Authority with regard to the Water Supply Byelaws.

NOTE PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.

NOTE The two parking spaces each numbered 17 and 18 should be allocated to residential apartments numbered 24 and 25.

NOTE The applicant is recommended to consider the introduction of an additional parking space alongside the wall opposite space number 1 and the doorway repositioned: this would permit car parking spaces number 24 and 25 to be used by those in apartment number 4

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -
- the time for requesting a review of the initial decision has expired; or
- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.
