The application seeks approval for the erection of a sunroom extension onto the rear elevation of a mid-terraced dwelling in Laxey.

Whilst the proposed extension is relatively minor and the impact on the neighbouring properties is acceptable an issue has arisen with the Department of Transport Drainage Division. They have concerns that extension is partially constructed on a wall that they are responsible for and have concerns about future stability and river maintenance. Whilst ownership is usually a civil matter

outside the remit of planning I would suggest that the potential detrimental impacts on the adjacent watercourse are a planning consideration as they are within the public realm. The matter has been discussed with the applicant but no suitable outcome reached. Accordingly, I recommend that the planning application be refused.

R 1. By reason that the proposed extension is partially constructed on the riverside retaining wall the proposed development would unacceptably prejudice: A) the future maintenance of the adjacent river; and B) the structural integrity of the retaining wall.

- 1. The applicant is advised that the Laxey River is designated as a main river under the Land Drainage Act 1934. Accordingly, works within the proximity of a main river will need to be agreed with the Department of Transport Drainage Division. It is recommended that any amended proposal is discussed and agreed with them prior to its formal submission.
