In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 15 July 2005, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to drawing numbers SC 745 PL 10-10,10-11,10-12,10-13,10-14,11-01,12-01 date stamped received on 19th May 2005.

3. No development may commence until there has been approved by the Planning Authority a scheme of landscaping which includes indications of all existing trees and hedges within the site and details of any to be retained together with measures for their protection during the course of construction.

4. The proposed hospice must be connected to the public sewerage system situated within Tromode Industrial Estate in a manner acceptable to the Department of Transport Drainage Division. All drainage works must conform to the requirements of the Department of Transport's 'Manx Sewers for adoption' and all necessary inspections/surveys (including cctv) are to be carried out at the developer's expense.

Full permission must be obtained from the relevant landowners in order to gain access to lay the proposed foul drain to the public system. A communication fee will be payable to the Department of Transport in respect of this drainage connection.

Note: It is a legal requirement under the Sewage act 1999 that the Department (as the drainage authority) be advised, in advance, of the date of the connection of the development to the public sewer.

5. There must be no discharge of surface water to the main foul sewer.

6. The applicant must supply foul discharge figures and agree the proposed surface water attenuation scheme with the division prior to any work commencing on site.

7. All services including electricity and telephone where installed must be laid underground.

8. Details of the materials and colours to be used on the exterior of the building must be submitted to the Planning Committee for approval prior to commencement of works. The roof must be finished in natural slate or high quality imitation slate.

NOTE The applicant is advised to consult with the Fire Safety Department as the proposed development will require a fire certificate issued under the Fire Precautions Act 1925.

NOTE The proposed foul and surface water drains from the development will not be adopted by the Drainage Division and will remain private once in use, with the responsibility for future maintenance falling to the applicant or its agents and their successors in titles.

NOTE The building should be built under the part M Building regulations. The Disability Access Office would welcome an invitation to view any plans so the Hospice when open fits the needs for everyone that will use it.

NOTE The MEA advises the applicant to contact the operations and Maintenance Manager as there are High, Low Voltage cables and Fibre Optic cables in the area highlighted in your planning application. This is to discuss working practices around these cables which also may be required to be diverted before any work can be carried out on site.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -
- the time for requesting a review of the initial decision has expired; or
- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.
