The site comprises the curtilage of a mid-terraced house in Falcon Cliff Court. The site fronts not only on to the estate road, but also on to Palace Road.

The application proposes

- (a) a garage set into the bank adjoining Palace Road; and
- (b) conversion of the integral garage into living accommodation.

The application is essentially the same as that refused in respect of 02/1688, but the applicant argues that circumstances have changed since that decision.

Whilst the (unauthorised) paving of the roadside bank has indeed altered the roadside appearance, and whilst the works at 17 Palace Road have been undertaken, I judge that we should accept the application but refuse for essentially similar reasons to 02/1688, Enforcement re paving?

R 1. The introduction of a roadside building as proposed would have an adverse effect upon the appearance and character of this part of Palace Road, and an approval would establish a precedent for further, similarly-sited garages.
