### Officer's Report

The site represents the curtilage of a private dwelling approved as part of the new All Saints' Park, under PA 02/1451. Since then, since the erection of the dwellings, such as this, which back onto the properties on Croit-e-Quill Road and Close, decking has been erected which has been the subject of planning applications.

The first of these which was refused by the Planning Committee (PA 04/1797), went to appeal where the Inspector concluded that due to the nature of the estate and the way it had been designed and built, the decking would provide where the development had not, for the private amenity space of the dwelling in question, without, in his view compromising or adversely affecting the privacy or amenities of the adjacent properties, sufficient to warrant upholding the refusal of that application for the decking. This recommendation was upheld by the Minister. A second application was also approved by the Planning Committee at review, following on from the other appeal decision.

Conditions were attached requiring retention of the perimeter fencing and introduction of planting between the decking and the properties behind. In the first case, there was an objection submitted within time, from the neighbour to the rear. In the second case an objection was solicited from a neighbour. In this latest case there are no objections from neighbours although the Lonnan Parish Commissioners have objected on these grounds.

This latest decking is not attached to the house but is at the same level as the ground immediately alongside the patio doors on the rear elevation. There is trellis fencing around the edge of the decking which will prevent overlooking of the property behind at least whilst users of the decking are seated.

Landscaping, as required previously would help the impact as viewed from alongside.

C 1. This permission relates to the erection of decking as shown in the submitted plans and photographs all received on 25th February, 2005.

C 2. The trellis balustrading around the decking must be retained as shown for as long as the decking remains in place.

C 3. Within three months of this notice becoming final the applicant must submit and have approved a landscaping scheme which will have the effect of softening the vertical emphasis of the structure and infilling the space beneath it.

C 4. Within three months of the date of this notice, the timber cross bracing must be removed and replaced with wire braces such as those required at number 12, All Saint's Park or timberwork as proposed at number 8, All Saints' Park.

C 5. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
