In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 1 April 2005, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. All services must be laid underground, and all soil-stacks must be constructed internally.

3. No development may commence until there has been approved by the Planning Authority a scheme of landscaping which includes indications of all existing trees and hedges within the site and details of any to be retained together with measures for their protection during the course of construction, this scheme must

include the retention of the small trees along the St Ninian's Road frontage (except insofar as they are affected by the formation of the new access).

4. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.

5. Prior to the commencement of any building operations, there must be submitted to and approved by the Planning Committee details/samples of the proposed slates, render, stonework, windows, cills, and paviors.

6. The proposed accommodation may be occupied only as sheltered housing; prior to such occupation, there must be submitted to and approved by the Planning Committee details of the occupancy constraints and the mechanisms for enforcing these.

7. Any Permitted Development Orders for the time being in operation will not apply to this site.

8. No unit may be occupied until such time as the parking areas and associated access routes and turning areas have been completed and are available for use.

9. No water or contaminants from the site shall be permitted to flow or be tracked on the highway.

**NOTE:** No approval is hereby granted or implied the formation of an access road through to the adjoining St Andrew's Church site.

**NOTE:** It is recommended that there should be consultation with the Fire Safety Department regarding fire precautions.

**NOTE:** The applicant's attention is drawn to the provisions of the Building Control Act 1991 which includes specific controls on, and requirements in connection with, demolition of buildings in whole or in part. For further information contact the Department's Office of Environmental Health.

**NOTE:** It is recommended that there should be consideration given to the recommendations of the Disability Access Officer, a copy of which is attached to this notice.

**NOTE:** The applicant is advised to consult the Water Authority with regard to the Water Supply Byelaws.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
