In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 18 March 2005, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

3. This approval relates to drawing number 170.3 date stamped received on 6th December 2004

4. The new frontage must match that of the existing bar 'Cork and Bottle'

5. The rating level of noise emitted from any plant or machinery, shall not exceed LAeq, 1 hour – 55dB daytime (0700 – 2300) and LAeq, 5 minute – 45dB night time (2300 – 0700) as measured at the boundary of any noise-sensitive premises.

The rating level shall be measured and calculated in accordance with BS 4142:1997.

N.B. Plant or machinery includes any refrigeration or ventilation plant.

6. The public bar area shall achieve 10 – 15 air changes per hour. In areas where heavy smoking occurs this requirement shall be increased by 50% to 15 – 22.5 air changes per hour.

NOTE The Application falls within the scope of the Fire Precautions Act 1975. The applicant is required to consult with the fire safety department to discuss the details.

NOTE The applicant is recommended to consider the provision of access which is suitable for wheelchair users and to have sufficient aisle width inside to allow an unassisted wheelchair user to manoeuvre and have at least one section of all serving counters suitable for wheelchair users (i.e. low enough to write a cheque). Where there are full length glass doors fitted they should be marked in some way at mid height to assist people with sight impairment.

NOTE This approval relates to limited use of the kitchen for microwave snacks and toasted sandwiches as shown on the plans. Any further use of the facilities would require re-consideration of the ventilation system and may require a further planning application.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -
- the time for requesting a review of the initial decision has expired; or
- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.
