### Officer's Report

The site represents the curtilage of Folly's - an established restaurant and bar situated between Harbour Road, Marine View Close, Furman Close and The Fairway and was formerly Molly's and the Howstrake Hotel. Proposed here is retrospective permission for the installation of decking at the north western part of the building between the main building and a row of garages one of which was converted to an office (PA 04/0584).

Permission was also applied for retrospectively for the construction of a changing room to service the cabaret (03/1835). This was refused as the room was not insulated and was giving rise to considerable noise nuisance to the properties nearby in The Fairway. I understand that steps have been taken to address this and that a new application will be submitted soon including appropriate noise mitigation measures. I also understand that the speakers within the building have been altered so that there is less noise emitted. I certainly have had no complaints recently about this.

This decking is approximately 5.7m by 7m and elevates this area approximately 300mm above car park level. The area is, I understand to be used for sitting out and possibly drinking and dining when weather permits.

It would be helpful to have confirmation from the residents in Marine View Close that there is neither any objection nor complaint regarding noise which has been experienced already.

I have written to the closest neighbours - 18 Furman Close and 3 and 4, Marine View Close, none of whom have written back. I can only assume that they do not have any objection.

On this basis I cannot see how any objection to this on the basis of noise nuisance could be sustainable.
