### Officer's Report

The application seeks approval for the erection of a dwelling and replacement shed within the curtilage of Lezayre Tea Rooms at Glen Duff, Lezayre.

There are no objections to the planning application.

Approval in principle for the erection of a dwelling and removal of living accommodation from café was approval on the 4th November 2003 following an appeal. The approval is subject to two conditions, which related to the size and occupation of the dwelling.

Whilst this application is not the reserved matters I consider it appropriate to attach significant weight to the reserved matters approval and conditions. I believe that the dwelling proposed by this planning application accords with the size, height and design condition imposed on the approval in principle. The condition regarding the occupation of the dwelling should be retained and imposed on the approval of this application.

The proposed replacement shed is very similar to that of the existing one and, as such, I consider it to be unobjectionable.

I recommend that the application be approved.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the concept plans and elevations, proposed plans and proposed elevations date stamped the 11th October 2004.

C 3. The dwelling hereby approved shall be used solely as living accommodation in association with the existing cafe/restaurant facilities and must not be sold or let off separately.

N 4. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
