### Officer's Report

The site represents a small square of land on the western side of the East Baldwin road between "Ballawyllin" and Ballachrink Farm. Proposed is the installation of a small pumping station to serve Ballachrink Farm, "Ballagarey" and "Ballachrink Lodge" all of which are properties owned by the Ballachrink Estate Trust. The reason for this is that presently the supply of mains water to these properties experiences insufficient pressure to provide a gravity feed up to these properties which lie at or above the water level at Injebreck reservoir in West Baldwin and as such all three are provided by a private water supply. The Trust has approached the Water Authority but the Authority will not address this problem.

The proposal involves a small pumping chamber with feeds to the properties.

I attended a meeting on site some time ago with the applicant's representative, Mr. Capp, the adjacent land owner and Mrs. Kelly also an adjacent land owner none of whom objected to the principle but had suggestions to make regarding the location of the pumping house and the feeds. Mr. Capp has written in confirming that he has no objection subject to the development not adversely affecting the use or future development of his land for agricultural or residential purposes. A condition could be attached to this effect although as the development will be on his land he has the ultimate control over how this is undertaken.

The outside of the chamber will be stone to match the surrounding walling and the top turfed so that all that is visible is the door and a drain hole. The chamber will be 1.8m in depth and 1.35m wide and around 1.5m in height, similar to the height of the existing stone wall surrounding the site.

There is a small layby for vehicles servicing or visiting the site to use although visits to the site will be minimal.

This proposal has been well thought through and discussed with neighbours and is necessary for the three properties concerned.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the installation of pipework, header tank and the erection of a pumping chamber all as shown in the plans and diagrams received on 21st October, 2004.

C 3. All pipework laid across agricultural land must be laid at a depth so as not to adversely affect the use of this land for such purposes including ploughing and planting.

I confirm that this decision accords with Government Circular No 57/01 (Delegation of Functions to Director of Planning and Building Control).
