The application seeks approval to change the use of a ground floor residential apartment in Ramsey to allow its use as tourist accommodation.

A recent planning application (03/01089) for the change of use of a dwelling to allow its use as tourist accommodation within a residential area in Andreas was approved on appeal. The appointed Planning Inspector concluded that the amenity of the surrounding properties would not be sufficient affected by tourist use. A time limit of five years was attached to the approval to ensure that the situation could be suitably monitored.

Whilst I have my doubts about whether anyone would actually want to use the property as tourist accommodation I accept that this is could not form the basis for the grounds for refusal. In terms of considering this planning application I believe that in view of this recent planning appeal it would be difficult to sustain a refusal and the impact of the tourist use in this location would probably not be sufficient to warrant refusal. Accordingly, I recommend that the application be approved subject to the imposition of a time limit of five years, in order to allow the situation to be monitored.

C 1. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

C 2. This approval shall be limited to a period of 5 years from the date of this notice, following which the use of the property shall revert to that of a residential dwelling.

C 3. This approval relates to the location plan and floor plan date stamped the 9th September 2004.

N 4. The applicant is advised to consult with the Fire Safety Department prior to the commencement of use as the premises fall within the scope of the Fire Precautions (Flats) Regulations 1996.

N 5. For a change in the water supply to a premises (domestic or commercial) the applicant should contact the Isle of Man Water Authority Byelaws Inspector (Les Quayle), telephone 695957.
