### Officer's Report

The application seeks approval for the installation of replacement windows in front and rear elevations of a terraced dwelling in Laxey.

The proposed replacement windows comprise of hardwood double glazed sliding sash in the front elevation (two windows - one at ground floor level and one at first floor level). The proposed replacement windows in the rear elevation are white uPVC windows. Whilst the application site is within a Conservation Area Steve Moore has advised that the use of uPVC windows in the rear elevation along Dumbells Terrace has previously been accepted.

The situation at the rear is somewhat unusual as the rear outlet of the dwelling has windows on the boundary with the neighbouring property, 12 Dumbells Tce. Following a site visit with the applicant I clarified the position of the proposed window, see my annotated site plan.

The occupant of 12 Dumbells Tce objects to the installation of uPVC on this joint boundary and cites a deed of covenant. Any such deed of covenant is a civil matter and not enforceable under the planning system. Therefore, I consider that the use of uPVC in the rear elevation is acceptable in terms of planning as the rear is not readily visible. However, I would suggest that the two windows on the joint boundary should be obscured and should either be fixed or use an opening style that does not overhang the neighbouring property.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the installation of replacement windows as shown in the location plan, photographs and window specifications date stamped the 15th September 2004.

C 3. The two windows that are located on the joint boundary with 12 Dumbells Terrace must be glazed using frosted glass with a level of obscuration no less than level 5 as detailed on the Pilkington's textured glass range or equivalent. Furthermore, these two windows must either be fixed shut or use an opening style that does not result opening over the neighbouring property.
