### Officer's Report

The site represents the curtilage of a detached dwelling in an estate of eighteen located on the southern side of the B12 road from Croit-e-Quill Road to Lonan Church (All Saint's).

Proposed here is retrospective approval for a slide which has been erected in the side garden.

This is not dissimilar to a tree house which has been erected at Number 12 and to which the applicant objected. This structure was around the same height but larger in size with swings beneath rather than a slide.

Both structures exceed the height of the boundary fence and seem, from the other side of the fence, to be sitting above it. In both cases there is opportunity to sit in the structure, although there is less space in this than there is in the tree house at Number 12. Whilst it may seem petty to refuse a children's slide, there should be consistency between the decisions taken on this and the tree house.

As such, this should be refused for the same reasons as PA04.

## Recommendation

Recommended Decision: Refused

Date of Recommendation:

### Conditions and Notes for Approval / Reasons and Notes for Refusal

C: Conditions for approval N: Notes attached to conditions R: Reasons for refusal O: Notes attached to refusals

R 1. The structure, by virtue of its height would overlook the rear garden and private space of Number 12 Church Close and would as such be unneighbourly.

- 1. As this structure has been refused, it must be dismantled within 4 weeks of this decision as it becomes final.
