# PA01/1614 Appeal Decision Notice

Please reply to the Chief Executive Our ref: RAH/AD Dear Sir/Madam, ON APPEAL: PA01/1614 – C J Bridson Ltd – Erection of 5 dwellings with associated car parking, land off Willow Terrace, Douglas. I refer to the recent appeal hearing in respect of the above planning application.

In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.

I am directed to advise you that the Minister, having considered the report, has agreed to accept the recommendation of the appointed person. Accordingly, she has directed that the Planning Committee’s decision to refuse permission should be reversed and that approval should be granted subject to the conditions to which the report refers in paragraphs 22 and 23. Formal notice of this decision is attached hereto.

In pursuance of her powers under the above Acts and Order the MINISTER for Local Government and the Environment, following report by the appointed person, does hereby APPROVE the application by C J Bridson Ltd for erection of 5 dwellings with associated car parking, land off Willow Terrace, Douglas, subject to compliance with the conditions or modifications specified on the attached schedule and numbered 1 to 5 inclusive.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, byelaw, order or regulation.

Note 2: A copy of the report of the appointed person is appended hereto.

PA01/1614 - ON APPEAL

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. All services must be laid underground and all soil stacks constructed internally.

3. Prior to the commencement of any works, there must be submitted to and approved by the Planning Committee an amended plan showing alterations to the stone wall alongside Plot 1, such as to improve access to the parking spaces; the works must be undertaken in accordance with the approved amended plan.

4. An amended plan, showing false chimney stacks, shall be submitted to and approved by the Planning Committee before the development commences. Such chimney stacks shall be built before the development is occupied.

5. Before any development commences, the applicant shall submit a method statement, dealing with the construction period. The development shall not commence until the method statement has been approved by the Planning Committee.
