ON APPEAL: Planning Application No: 04/01414 – Fong Kwai Tang – Retrospective application for the installation of ceramic tiles to ground floor front elevation, 16/16A Michael Street, Peel.

I refer to the recent appeal hearing in respect of the above planning application.

In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.

I am directed to advise you that the Minister, having considered the report, has agreed to accept the recommendation of the appointed person. Accordingly, he has directed that the appeal be dismissed and that the decision of the Planning Committee to refuse the application be confirmed.

Additionally, the Minister has noted that the application is retrospective, and that the works have already been undertaken. In these circumstances, he has directed that, within one month of the date of this letter, there must be submitted to the Planning Committee for approval a scheme for restoring the frontage (or for re-tiling in appropriate, muted colours). The scheme, once approved by the Committee, must be completed within three months of its being approved. Failure to comply with this direction will result in consideration being given to legal action in respect of an offence in terms of articles 4 and 21 of the Isle of Man Planning Scheme (Dev’t Plan) Order 1982.
