In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 10 December 2004, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to plan number 1 and information submitted as part of this application and date stamped 3rd June 2004 and 02 Rev B date stamped 15th October 2004.

3. There must be no discharge of surface water to the main foul sewer.

4. Prior to the commencement of any works on site the trees to be retained and shown in drawing 02B must be adequately protected against damage during and after construction. This should take the form of fencing off of all the trees to the west of the house footprint and retaining this area free from vehicle movement or the storage of materials both during and after the course of construction.

5. The window in the dormer facing south (i.e. that serving the bathroom in the attic) must be fitted with obscured glass and retained as such in perpetuity.

6. The development must include the erection of a 2m high perimeter fence along the southern boundary of the site to maintain the privacy of both the proposed property and those to the south. This fence must be painted or stained dark brown or dark green prior to its erection in order to minimise the need for maintenance on the southern side of the fence.

7. The proposed development must be connected to the main foul sewer.

NOTE: A Drainage Connection Fee will be payable to the Drainage Authority on this development

NOTE The applicant is requested to supply the Drainage Division of the Department of Transport with a copy of any Building Control Application in relation to the surface water discharge from this development.

NOTE The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.

NOTE The applicant is advised to consult the Department of Agriculture, Fisheries and Forestry with respect to the creation and implementation of a tree management programme for the wooded area, in time replacing those trees of poor form and quality with the new deciduous trees of an appropriate species.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
