In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 27 May 2005, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to the installation of oil tanks and fencing, removal of one tree, internal alterations, installation of ATM machine and alterations to the side and rear elevations all as shown in the drawings submitted 405/01, 06/Rev a and 07/ Rev 2 all received on 4th June, 2004 and the information on noise and odour attenuation received on 23rd September, 2004 from Construction Design Limited.

3. The rating level of noise emitted from the plant shall not exceed LAeq, 1 hour - 40dB daytime (0700 - 2300) and LAeq, 5 minute - 30 dB night time (2300 - 0700) as measured at the boundary of number 33, Birch Hill Avenue.

The rating level shall be measured and calculated in accordance with BS 4142:1997. Plant includes any refrigeration or ventilation plant and electricity substation.

4. In order to prevent objectionable and offensive odours to local residents, the discharge stack for commercial kitchen exhaust systems shall discharge the extracted air not less than 1m above the roof ridge of any building within 20m of the building housing the commercial kitchen. Additional odour control measures shall be incorporated to prevent any adverse impact of odour to local residents such as either:
i) fine filtration or ESP followed by carbon filtration (carbon filters rated with at least 0.1 second residence time) or
ii) fine filtration followed by counteractant/neutralising system to achieve the same level of control as above.

NOTE If the requirements of odour control cannot be satisfied in conjunction with the above advice, alternative methods of controlling odour emissions must be agreed with the Planning Committee after consultation with the Environmental Health Division.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.

Note 3: Rights of the appeal against the decision of the planning committee are attached.

Note 4: An appeal must be requested within a period of 21 days.
