### Officer's Report

The site lies on the coast road between Kirk Michael and Peel and represents the curtilage of an existing dwelling formed from the conversion of a former chapel on one side of the road and on the southern side of the private lane is a holiday cottage which also belongs to the applicant. In this southern part of the site, the applicant has undertaken decking work over a stream which runs through the garden. This is 4.8m by 7.5m, is placed 2.5m above the stream bed and has a hand rail of approximately 1m in height.

This has no adverse impact on the appearance of the site. The objection from DoT drainage relates to works which have been undertaken in culverting the stream. This is not included in the application and does not relate to the works proposed so I cannot comment on it. Plannnig permission should however have been sought for this and separate enforcement action should be instigated in this respect.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the erection of decking as shown in drawings reference AT 660.3 and the location plan both received on 29th June, 2004.

N 3. Whilst objections have been raised in respect of other works which have been carried out on the site, specifically culverting an existing stream and other related works, these do not form part of this application and as such will be addressed separately through appropriate enforcement action.
