REASONS FOR REFUSAL

Application Ref No: 00/02398/A On Review

1. The access to the site would be via the minor road (U26) leading from South Cape to Old Laxey Hill which also crosses the Manx Electric Railway. The frontage of the site onto the minor road is of limited length. Due to these two factors, the Committee is not persuaded that there can be a safe means of access whereby the safety of users of the access, together with users of the Manx Electric Railway and the public road could be assured. Whilst an amended means of access is shown, it is not clear whether the short length of lane between the site and the public highway is within the ownership of the applicant or whether he has a right of way over it: it is certainly outwith the defined site. In any case, the road onto which the site will discharge is of limited width, has poor manoeuvring opportunities and forward visibility and the access from this onto other public roads, particularly onto Old Laxey Hill has very limited turning space and again, poor visibility for emerging vehicles, as such the road is considered unsuitable to accommodate increased traffic.

NOTE It should be noted that none of the trees which exist on or near the site have been shown on the submitted drawings and as such it is not possible to assess whether, notwithstanding the concerns listed above, the development could proceed without tree loss.
