## Item For Delegated Consideration **FROM:** Anthony Holmes, Planning Officer **DATE:** 5th March 2009 **Re:** PA 04/00660/B - Erection of a two-storey general purpose storage building to replace existing. Fields 2166 & 2205, Sky Hill, Lezayre Road, Lezayre. A request has been received from Mr Howard to extend the date of expiry of the above-approved planning application. The planning approval expired on the 3rd March 2009; the request to extend was received on the 26th February 2009. Under article 13 of the Town and Country Planning (Development Procedure) Order 2005 the Department has power to extend the duration of a planning approval provided there are special circumstances to justify a longer period. In this respect, Mr Howard has advised that work has not commenced for financial reasons. In my view, a stated lack of finance to enable the commencement of development does not constitute special circumstances in accordance with the order. Furthermore, the planning application was the subject of objection, review and appeal. Taking this into account I recommend that the request is dismissed. Signed *Mr A Holmes* Planning Officer
