In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

which was considered on 28 January 2005, subject to compliance with the conditions specified below.

#### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to drawing numbers 0432/1/1 and 0432/1/2 date stamped the 20th April 2004 and drawing number 0432/1/3 date stamped the 28th July 2004.

3. This approval for the development and use of the site is hereby limited to a period of five years from the date of this notice. After this time, unless further planning approval is granted, the application site must be cleared and returned to its previous state.
4. This approval permits the acceptance, crushing and screening of inert waste only. For the avoidance of doubt inert waste is hereby defined as waste which when disposed of in or on land does not undergo any significant physical, chemical or biological transformation and may include soil, clays, sand, brick, concrete, ceramic materials, glass and slate.
5. No plant or machinery associated to this approval shall operate within the application site before 09:00 on weekdays and Saturdays or after 18:00 on weekdays or Saturdays, or at any time on Sundays or Bank Holidays.
6. The rating level of noise from the operation of plant and machinery on the application site shall not exceed L(A)eq, 1 hour - 50db measured at the boundary of Woodside, Woodside Cottage, Woodcroft Cottage or Decca House.
7. There must be no discharge of surface water (directly or indirectly) from the development and use to any foul drainage system(s).

NOTE In relation to condition number 6 the applicant is advised that the rating level shall be measured and calculated in accordance with BS 4142:1997.

NOTE The applicant is advised that a waste disposal license will be required for the operation of the site, contact (01624) 685963.

This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -

- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.

Note 3: Rights of the appeal against the decision of the planning committee are attached.

Note 4: An appeal must be requested within a period of 21 days. t
