REASONS FOR REFUSAL

Application Ref No: 04/00883/A

1. There is in the application insufficient information to allow a proper assessment of the air extraction system that would inevitably be required in association with the proposed restaurant/takeaway use. In so far as it has been possible to assess the proposed use, it has been judged that that it would create noise, disturbance and smells which would have a harmful effect on the amenity of nearby residents.

2. Notwithstanding the above, there are limited opportunities for on street parking along the Main Road which is a particularly narrow stretch of the A3 highway through Kirk Michael Village. The use and in particular the takeaway use would lead to an increase in on street parking including illegal parking which would be contrary to the interests of road safety.

3. This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
