## Town and Country Planning Acts, 1934-1992

**TOLK OF MAN PLANNING SCHOOLS (DEVELOPMENT PLAN) ORDER 1982**

In pursuance of their powers under the above Acts and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby APPROVE the application made by you.

Extension of existing quarry, Stoney Mountain Quarry, Malow.

Which was considered at a meeting held on the 14th January 1994, subject to the compliance with the conditions or modifications specified on the attached schedule, numbered 1 to 15.

## December Of Conditions

Application No. 9-1-01

1. This approval is for a period of 10 years only.

2. There shall be no working within 10m of the perimeter of the site which must be securely fenced off from the adjacent plantation.

3. All access to the quarry extension area for the purposes of stripping overburden and excavation must be taken from mud roads within the quarry.

4. There shall be no access to the site from any realigned footpath/truck through the plantation to the north west and south west of the quarry.

5. No development shall take place until adequate provision for the realignment of the footpath/truck outwith the site has been made to the satisfaction of the Department of Agriculture, Fisheries and Forestry and the Planning Committee.

6. For the purposes of mitigating the impact of the development on the landscaping, in addition to the landscaping proposals shown on plan INN 0002/001D/21 the following shall be undertaken:

- All disused buildings and structures, derelict machinery and equipment must be removed before regrading takes place.
   - Excavation and regrading of existing overburden banks must be undertaken simultaneously.
   - Planning of regraded slopes should be undertaken, at the latest, in the first planting season following commencement of excavation of the extension.
   - No more than a 20m wide strip of land shall be cleared of trees and overburden in advance of working.
   - Overburden so stripped shall be moved immediately to the areas shown on plan INN 0002/001D/01 and no overburden shall be left in piles on unexcavated ground.
   - All topsoil and overburden must remain in the quarry and be used in the landscaping works.

7. Plan for the afteruse of the whole quarry area must be agreed with the Department of Agriculture, Fisheries and Forestry and Department of Local Government and the Environment and submitted to the Planning Committee within 5 years of the approval of this application.

8. Adequate provision must be made for the drainage of the site and there must be no pollution of adjacent watercourses, the committee reserves the right to monitor the effect of the excavation in creating additional surface water and the effectiveness of the existing drainage system and to request additional works if necessary to cope with any problem arising.

The working hours of the operations on the site shall be restricted to Monday - Friday 0800 - 1700, Saturday 0800 - 1200. The site shall not be operated on Sundays and Bank Holidays. For the purpose of this condition operations include drilling, blasting, movement, crushing and screening of rock and grading of overburden.

There shall be no tipping of materials generated from outwith the site.

To ensure safe working of the site the following practices must be adopted:

- the working faces shall be benched so that no vertical or near vertical face exceeds 15 metres in height.
- no haul road shall be at a gradient steeper than 1 in 12, and the edges of the haul road shall be protected by 1.5 metre high earth banks to prevent vehicles falling from the edges of the haul road.
- the quarry owner should be able to satisfy the Committee that no risk is life by any person who is not competent to do so in a safe and workmanlike manner in accordance with the Isle of Man Quartier Regulations (use of Explosives) 1951. Also, in accordance with the general duty imposed by Section 3 of the Health and Safety at Work etc Act 1974 as applied to the Island, the other persons who may be affected by the way in which the undertaking is carried out, in particular by ensuring that appropriate blasting techniques are used to avoid danger to persons in nearby premises from the dangers of fly rock.

Separate planning application must be made for any new building, fixed plant and equipment.

No advertisement matter of any description shall be exhibited at this site without the PRICE written permission of the Committee.

Hans National Trustees shall be advised, in advance of the start of site clearance operations and given the opportunity of inspecting the site from the commencement of earth movement and during the excavation of all trenches (including service trenches) as deemed necessary and of investigating any archaeological features exposed.

All workmen on the site should be informed of the sensitive nature of the site so that any finds and/or traces of archaeological activity can be reported promptly to the Hans Museum in accordance with Hans Law. Attention is drawn to the requirements of the Hans Museum and National Trust Act 1952/86.

SEQUENCE OF CONDITIONS Application No. 52/1188 NOTE 1: Prior to the commencement of development a licence/issue must be obtained from the Department of Industry.

NOTE 2: Prior to the commencement of development a felling licence must be obtained from the Department of Agriculture, Fisheries and Forestry, Amenity and Lands Division.

NOTE 3: The applicant is recommended to take action to ensure that all public highways to the quarry are kept clear of parked and scrap vehicles, particularly at the junctions of the site access road and the Stoney Mountain Road and the Stoney Mountain Road and Eairy (H36) Road, so that there is no damage to private property by quarry related vehicles turning/manoeuvring.

NOTE 4: It is noted that the location of the quarry is incorrectly shown on drawing number IHM 0002/001D/03.

NOTE 5: The Health and Safety Inspector advises that adequate provision must be made for the safety, health and welfare of all persons who may be affected by the undertaking and there must be compliance with the appropriate statutory requirements including in particular the requirements of the following legislation to the satisfaction of the Department of Local Government and the Environment and, as the case may be, the Chief Health and Safety Inspector and the Chief Constable.

NOTE 6: The applicant is advised to discuss further the landscaping proposals in accordance with the letter dated 18th January 1994 (copy attached) from the Department of Agriculture, Fisheries and Forestry.
