Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -

- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.

Note 3: Rights of the appeal against the decision of the planning committee are attached.

Note 4: An appeal must be requested within a period of 21 days.

## Schedule Of Conditions

### Application Ref No: 02/00366/B

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. All services must be laid underground.
3. The building must be provided with sprinklers throughout.

Note: It is recommended that there should be continued liaison with the Fire Safety Department.
4. The building may not be occupied until the proposed access arrangements and parking spaces have been completed and are available for use.
5. All tandem parking spaces must be allocated and managed such that each set of these spaces is used and controlled by a single occupying company.
6. Prior to the commencement of any works, there must be submitted to and approved by the Committee a method statement detailing the sequence and manner of all construction works, including the provision of services; this statement should include arrangements for maintaining the integrity and security of the port facility.

Note: It is recommended that the Department of Transport should be consulted during the preparation of this statement.
7. The permanent security fence between the site and the port must be completed prior to the building being occupied.
8. Prior to the commencement of any works, there must be submitted to and approved by the Planning Committee:-
(a) detailed, large-scale plans of the external space around the building indicating all paving, soft-landscaping, street furniture, and fences, walls, and any other barriers;

Note: these plans should be prepared in consultation with the Highway Authority and the Planning Office, and should demonstrate how the proposals are coordinated with the treatment of adjoining spaces; details of the security fence referred to in condition (7) must be included.
(b) samples of all flagging, kerbing, edging etc employed in the scheme required in (a) above;
(c) detailed, large-scale plans of the atrium roof demonstrating the means of support and fixing;
and
(d) details of the method and manner of operation of all opening lights.

Note: In the Committee's judgement, opening lights which breach the face of the building may have an adverse effect on the appearance of the building.

9. There must be included within the scheme required by condition 8(a) above opportunities for the inclusion of public art, both within the building and in the public spaces around it, and details of how they will be implemented.

NOTE The applicant should obtain approval from the Operations Section of the Department of Transport before carrying out any work within the highway; this includes the use of the highway during the construction phase, and safety measures and provisions for pedestrian movements past the site (tel: 686665).

NOTE The applicant should liaise with the Department of Transport with regard to the detailed design (including levels) of highway-related elements of the proposals; all construction details should be in compliance with Manx Roads 2.

NOTE The building and facilities within it and the spaces around it should be accessible and usable by an unassisted wheelchair user in accordance with BS. 8300; the Disability Access Officer may be consulted hereon (tel: 619937).
