### Officer's Report

### The Site

The site represents the curtilage of an existing terraced property situated on the western side of Bay View Road, to the south of the Bay View Hotel and to the north of Park Road, in a terrace of seven properties. The property is a three storey property with modern, plastic-framed windows. The property is taller than that immediately to the north, which has a lower ridge and dormer windows in the top floor. The properties on each side are residential dwellings, the application property is a dental surgery with living accommodation above.

### Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 and the draft Southern Area Plan published on 23rd October, 2009 as Residential.

### Planning History

Planning permission was sought and granted for the upgrading of the dental surgery under PA 90/0341 and a replacement door was permitted under PA 07/0731.

### The Proposal

Now proposed is the conversion of the first floor flat to additional dental facilities - a second waiting room, staff bathroom, reception, staff kitchen and waiting room and a second surgery. On the ground floor there will be a decontamination room provided in place of the second surgery with some internal alterations which would not require planning permission.

There are no external changes to the building. The top floor is presently used as an open plan living room and will be used for storage with no changes to the layout of the space.

## Representations

Department of Transport Highways and Traffic Division and Port St. Mary Commissioners indicate that there are no adverse highway implications from the proposed development

### Assessment

Whilst the existing use is technically non-conforming in that it is not a residential use, it is complimentary to a residential area in that it provides health-related services within walking distance of most residents in the village and right alongside the public transport network. There is no car parking associated with the premises other than that which is available on street. However, the proposed new facilities will replace a residential unit which itself generates a need for parking. As there are mostly residential properties alongside this premises, the demand for on street car parking is likely to be highest at weekends and in the evenings when the dental surgery is unlikely to be operational. The current ground floor surgery does not appear to have given rise to problems with immediate neighbours and as such, it is unlikely that extending the operations upward within the building will result in problems although these facilities are more likely to be alongside bedrooms where higher levels of peace and quiet may be expected.

There are no objections to the proposed use, from local residents or the local authority. The increased business for the local dental surgery is a positive sign for the economic viability of the village and the proposed increase in facilities can only be aof benefit to the village. The site is suitable for the use, close to the public highway network and many local residents. As such, the proposed development is considered to be acceptable.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the use of the first floor as a dental practice, as shown in the plans reference 1492-01A received on 21st January, 2010.

For clarification no approval is being sought, nor is granted to the use of the upper (second) floor as part of the dental practice and if such use is proposed, this must form the subject of a new planning application.
