### Officer's Report

#### The Application Site And Application

The application site comprises an area of land located on the northern side of that contains a number of industrial units

The application seeks consent for the erection of signage within the application site.

#### Planning History

Through a combination of previous planning applications 06/01170/C and 08/02311/B the application site has planning approval for the existing industrial units contained within it.

#### Representations

Braddan Parish Commissioners have no objection to the application.

The Department of Transport Highways do not oppose the application.

The owner and occupant of 27 Vicarage Park objects to the application. The state that whilst they no objection to the design of the signage they consider the choice of wording to be objectionable. It is their opinion that "Kirby Farm Commercial Park" would be appropriate than "Kirby Farm Industrial Estate".

Two individual representations have been received from the owners and occupants of 30 Vicarage Park. Whilst these both object to the application the reasons for their objection differ. One of the occupants objects to the choice of wording on the proposed signage and suggests that that "Kirby Farm Commercial Park" would be

appropriate than "Kirby Farm Industrial Estate". They also query the overall number of units contained within the application site. The other occupant objects to the erection of the signage at the entrance to the application site on the grounds that it would be unattractive and unnecessary.

The owner and occupant of 33 Ballaquark supports the application. It is their opinion that the proposed signage is an elegant solution to an existing problem.

## Planning Policy

In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application.

General Policy 6 states:
Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:
- (a) are of a high standard of design and materials and relate well to the building and site on which they are to be displayed;
- (b) are in keeping with and do not detract from the surrounding area; and
- (c) are located so as not to cause a highway safety hazard.

### Assessment

The application seeks consent for the erection of signage within the application site. The proposed signage comprises of two signs either side of the entrance to the application site and one sign internal to the application site. The two entrance signs, which are approximately 1.1 metres high and 1.2 metres wide, are shown as containing the name of the application site, i.e. Kirby Farm Industrial Estate. The internal sign, which is approximately 3.2 metres high and 1.5 metres wide, is designed to list the various occupants of the units contained within the application site.

It is reasonable to say that there has been an ongoing issue with some of occupants of the units placing their own signage at the entrance to the application site, which is presumed to have been done to aid visitors trying to find the site. The proposed signage appears to be an appropriate solution to this issue and should remove any need or possible grounds for the various individual signs that are currently visually detrimental. The two signs at the entrance are neat and appropriately positioned thereby neither harming visual amenity nor highway safety. The internal sign is sufficiently set within the application site so as not cause any significant harm. In terms of other issues raised within representations it is should be noted that the specifics of the wording contained within signage is not a matter of control by the Planning Authority. As such, the use of "Kirby Farm Industrial Estate" is not a material consideration in the assessment of the application.

It is recommended that the application be approved.

### Party Status

It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:

Braddan Parish Commissioners (statutory consultee); and The Department of Transport Highways (statutory consultee). It is considered that the following parties that made representations to the planning application do not meet the criteria of Government Circular 1/06 and should not be afforded interested party status:

The owner and occupant of 27 Vicarage Park (no physical adjoining land ownership and too distance from application site to be materially affected); The owners and occupants of 30 Vicarage Park (no physical adjoining land ownership and too distance from application site to be materially affected); and The owner and occupant of 33 Ballaquark (no physical adjoining land ownership and too distance from application site to be materially affected).
