### Officer's Report

### The Site

The site represents the curtilage of a former carpet shop and prior to that a car showroom, located on the corner of Church Road, Bridson Street and Station Road, in the centre of Port Erin. The site has frontages to each road of  and 23.5 m respectively. The building on the site is a single storey with varying roof shapes and with a large expanse of forecourt onto Station Road and warehouse style doors and access onto Church Road. There is a glazed shop front onto Station Road.

### Planning Status

The site lies within an area designated on the Port Erin local Plan of 1990 as Mixed Use. On the draft Southern Area Plan published on 23rd October, 2009 the site is identified as part of a small Regeneration Area within a wider area of Mixed Use. The Written Statement accompanying the draft plan states: "A possible area for the regeneration of the centre of Port Erin has been identified. Any redevelopment should include a significant element of convenience goods floor space as part of a wider mixed use scheme which is carefully linked and integrated to the existing centre. The Department will work closely with the Port Erin Commissioners and the Regeneration Committee to investigate how best to take this forward". The area extends to the north across Church Road to land which is not part of this site.

The following applications have been submitted in respect of this site:
PA 90/00663/B - Alterations to exterior doors, old Shore Garage premises, Station Road, Port Erin. Status - Permitted 1st January 1994

PA 02/00655/C - Change of use of former garage to carpet warehouse Status - Permitted 22nd August 2002 Conditions

1. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

PA 02/00657/D - Erection of advertising signs to proposed carpet warehouse Status - Permitted 22nd August 2002 PA 04/00342/C - Change of use of part of car park to hold an open air market one day per week in Summer and the occasional Sunday Car Boot Sale, car park to front of Wise Mann Carpets Status - Permitted - 6th April 2004 Conditions

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. For the avoidance of doubt, this approval relates to the holding of a Market on one day per week and Car Boot Sales on any Sunday, as indicated in the plans and information submitted as part of this application, date stamped 23rd February 2004.
3. The use of the site must cease on the last day of April 2005.
4. The use of the site hereby approved shall be discontinued after the date of the foregoing condition and the land must thereafter revert to its former approved use unless an appropriate planning approval is in place to continue the use beyond the last day of April 2005.

PA 04/02148/C - Change of use of park car park to hold an open air market one day per week April till October and December and the occasional Sunday car boot sale, car park in front of Wise Mann Carpets Status - Permitted - 21st December 2004

### Conditions

1. This approval relates to the holding of a Market on one day per week and Car Boot Sales on any Sunday, as indicated in the plans and information submitted as part of this application, date stamped 18th October 2004. For the avoidance of doubt, this approval permits the continued use of the site in the manner described above beyond the last day of April 2005 which was the time limit specified under PA 04/342/C.

PA 09/01973/D - Erection of advertising signage Status - Pending Consideration

### The Proposal

Proposed is the conversion of the former carpet shop to a car sales, valeting and storage facility. No alterations to the outside of the building are proposed but there is a further application for the erection of signage (see above). Access to the building would be from Church and Station Roads for vehicles and pedestrians would enter the premises from the sides of the main showroom and from the rear showroom off Church Road. There is car parking available around the building for customers.

## Representations

Department of Transport Highways and Traffic Division raise no objection to the application Port Erin Commissioners seek a deferral.

### Assessment

The site lies within an area of Mixed Use on the Port Erin Local Plan and the proposal seeks a commercial use for the building, which is a prominent one within the village and one which was previously used for the sale and repair of motor vehicles. There is good access for pedestrians and vehicles and plenty of car parking within the site for the display and manoeuvring of vehicles for sale and those of customers and staff.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
