### The Site

The site represents the curtilage of an existing dwelling situated on the south western side of The Parade in the heart of Castletown, located between The Coop and 6A, The Parade - now part of Balcony House - a residential property. The application property is a three storey property - at the rear, which is the subject of this application, there are five levels of windows in the property and the rear annex, almost all containing 20 year old timber sliding sashes except for the basement level windows are top hung casements.

### Planning Status

The site lies within an area designated on the Castletown Local Plan of 1991 and the draft Southern Area Plan published on 23rd October, 2009 as Mixed Use, reflecting the variety of uses in the vicinity. The site also lies within Castletown's Conservation Area and the building is Registered (RB 37).

No planning applications have been submitted in respect of this property.

### The Proposal

The application seeks permission for the replacement of the existing windows with new double glazed timber framed sliding sashes with "true" glazing bars.

### Assessment

As the property is Registered the content of this application has been considered with particular regard to POLICY RB/5 ALTERATIONS AND EXTENSIONS and, as the property is located within the Castletown Conservation Area, Policy CA/2 SPECIAL PLANNING CONSIDERATIONS OF CONSERVATION AREAS as set out within Planning Policy Statement 1/01- Policy and Guidance Notes for the Conservation of the Historic Environment of the Isle of Man.

In addition, Planning Circular 1/98 states the following in respect of properties within Conservation Areas and where the building is Registered:

"If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows MUST BE THE SAME as the originals in all respects, including the method of opening, materials and detailed design."

The drawn application information and accompanying photos indicate that there are two window formats, the later Victorian '2 over 2' format and the earlier Georgian '6 over 6' format. Doubtless the original format would have been the Georgian '6 over 6' format. A close inspection of the photos indicates mitre joints to the top corner joints of both types of sashes and a glazing bar that externally at least, is contemporary with one another. This suggests that the lower multi planed windows are not the originals.

The rear elevation already has the proposed window format, so there is little visual change from the public thoroughfare. These proposals will provide a unified fenestration to the rear of the property and, on the basis of the above, these proposals are acceptable.

**RECOMMENDATIONS** Recommend approval of this application. **PARTY STATUS**

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

This permission relates to the replacement of the windows as shown and described in drawing reference 80.1.09 and the site and location plans all received on 25th November, 2009.
