**Application No.:** 09/01623/B
**Applicant:** Clear Pharmacy Ltd
**Proposal:** Installation of a new shop front
**Site Address:** - 8 Michael Street Peel Isle Of Man IM5 1RF ### Considerations Case Officer : Mr Steve Stanley
**Expected Decision Level:** Senior Planning Officer ### Written Representations 52 Alberta Drive Onchan Isle Of Man IM3 1LX Objects to the proposal ### Consultations Consultee : Highways Division Notes: Do not oppose Consultee : Peel Town Commissioners Notes: approved. Consultee : Disability Access Officer Notes: please ensure the entrance doors are at least 900 mm wide and there is level or ramped access.

### Officer's Report

### The Site

The application site represents the curtilage of 6-8 Michael Street, Peel. The property is situated on the southern side of the street.

### The Proposal

This application seeks approval for the installation of a replacement shopfront. The existing shop front results in the top third of the window being covered. The proposed shop front would introduce a full height aluminium framed shopfront and centrally located door.

### Planning Status

The application site is located within an area identified as being within an area of Mixed use by the Peel Local Plan. The site is also within the Peel Conservation Area. Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered relevant:

Environmental Policy 35, which states:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

**PLANNING HISTORY** The following previous planning application is considered relevant in the assessment and determination of this application: 87/00908/B Use of premises as shop with new shopfront. This was approved.

08/02063/B sought approval for the installation of a replacement shopfront. The scheme proposed was similar to this proposal however the door was to be off-set. This was permitted.

**REPRESENTATIONS** The Department of Transport Highways Division does not oppose this application. Peel Town Commissioners have not commented on this application.

The Isle of Man Victorian Society objects to this application on the basis that a shopfront of the right material, scale and design would be more appropriate.

The Disability Access Officer has commented on this application.

**ASSESSMENT**

The main issues to be considered in the assessment of this application is whether the proposed development would preserve or enhance the Conservation Area in accordance with Environmental Policy 35.

The existing shopfront is not visually attractive and as such does not contribute positively towards the special character of the Peel Conservation Area. Whilst the proposed shopfront is not timber framed which would be more appropriate to this setting, the scheme would represent an improvement to the streetscene by reinstating the full height of the window in line with the adjacent property. It is judged that this would enhance the Conservation Area and accordingly it is recommended that the application be approved.

**RECOMMENDATION**

Permit.

## **PARTY STATUS**

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

Accordingly the following parties are not granted Interested Party Status:
