### The Site

The site represents the curtilage of a detached two storey dwelling which sits on the right hand side of the small cul de sac of six dwellings - number 8 -13 The Willow. these properties all lie within a larger residential area which sits to the east of Station Road (A5). The application property backs onto a conifer hedge which backs onto the side of York Mews, a row of two storey properties.

### Planning Status

The site is designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 and the draft Southern Area Plan published on 23rd October, 2009 as Residential.

PA 07/01257/B - Alterations, convert part of existing garage into living accommodation and erection of a detached replacement garage Initial Decision - Permitted 21st August 2007 Conditions

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This permission relates to the erection of a detached garage and the conversion of the existing garage to living accommodation with extension above all as shown in drawings reference AT 879.1 and the site and location plans all received on 2nd July, 2007.
3. There must be no discharge of surface water to the main foul sewer.

## The Proposal

Now proposed is the installation of a toilet in the rear of the garage which was permitted at the rear of the garden under PA 07/1257. The toilet occupies 1.8 m by 1 m of the garage and there still remains an area large enough for two vehicles to be parked side by side. The window arrangement in the elevation facing towards the rear garden is to be slightly changed with two sets of windows rather than one. The driveway would accommodate at least a further three cars one behind the other.

### Representations

Malew Parish Commissioners and Department of Transport Highways and Traffic Division both indicate that they have no objection to the application.

### Assessment

The proposal represents a very minor alteration to the approved garage, and the proposed changes will not affect its function or its appearance from either public or neighbouring views.

As such the application is considered to be acceptable.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
