### The Site

The site represents the ground floor of 21, Station Road, an existing shop unit on the northern side of the road opposite the railway station. The premises have been used as a sports massage clinic since PA 97/0528.

### Planning Status

The site lies within an area designated on the Port Erin Local Plan of 1990 as Mixed Use and similarly on the draft Southern Area Plan published on 23rd October, 2009. The site also lies within an area identified as a potential Conservation Area which stretches from Breagle Glen to Spaldrick.

### Planning History

Planning permission was sought and granted for the change of use from a shop to a massage therapy clinic under PA 97/0528.

## The Proposal

Proposed is the change back from sports massage therapy to retail - Class 1 of the Use Classes (Permitted Development) Order 2005. No changes are proposed to the building.

### Representations

Department of Transport Highways and Traffic Division raise no objections. Port Erin Commissioners recommend that the application is permitted Disability Access Officer recommends that when the shop is being fitted out provision is made for disabled persons' ramp and door facilities. There are no proposed changes to the building so this cannot be required by condition

### Assessment

The area is designated as Mixed Use and as such either sports therapy or retail purposes would be acceptable in these premises. Class 1 permits a range of retail uses any one of which would complement the area and the village centre generally.

No changes are proposed to the building. As such this application is recommended for approval.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
