## Supplementary Statement

The two bungalows that were permitted under review in 2002 (P/02/00159/B) did not have permitted development rights removed, even though the bungalows are on tight plots.

The General Permitted Development Order 2005 states that the erection of a private garage is permitted development unless:
a) there would be more than one private garage within the curtilage of the dwelling;
b) the height of the garage would exceed 4 m above ground level;
c) the width of the garage would exceed 6 m or be less than 2.4 m ;
d) the length of the garage (measured at right angles to the plane of the vehicular entrance) would exceed 6 m or be less than 5 m ;
e) any part of the garage would be nearer to any highway which bounds the curtilage of the dwellinghouse than -
(i) that part of the dwellinghouse nearest to that highway, or
(ii) 5 m ;
(iii) Any part of the garage would be within 9 metres of the bank of any river designated as a main River under the Land Drainage Act.

To be permitted development the proposal must accord with a set of conditions including "the roof must be pitched and finished to match the pitch and finish of the roof of the dwellinghouse." Furthermore, there are no permitted development rights applicable if the dwellinghouse is under construction. The proposed development did not accord with the above mentioned condition and therefore did not warrant any permitted development rights. The proposed development was thus assessed as a planning application on its planning merits, which was considered to be unneighbourly development that would have a detrimental impact on future occupiers.
