# Refusal Decision Notice

## Town and Country Planning Act 1999

### Town and Country (Development Procedure) Order 2005

Penketh - Millar
23 West Quay
Ramsey
Isle of Man
IM8 1DL
In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby REFUSE the following application made on behalf of:

Name:
Proposal:
at:

Mr Norman West
Erection of two detached timber agricultural buildings
Ballasleig Croft
Ballacorey Road
Andreas
Isle of Man
IM7 4EL
which was considered on 12th July 2010, for the reasons set out below.
Date of Issue: 13th July 2010
Murray House
Mount Havelock
Douglas

Mrs P Faragher
Deputy Secretary to the Planning Committee

### Reason(S) For Refusal:

1. The application represents development in the countryside which is protected for its own sake by virtue of Strategic Plan Environment Policy 1. The Strategic Plan makes provision for exceptions to this policy, as set out in General Policy 3 and Environment Policy 15 which make exception for agricultural buildings which are justified by agricultural need. In this case such need has not been demonstrated as the site defined in red represents a very small piece of land which currently does not represents a viable agricultural holding; the proposed development is therefore contrary to General Policy 3 and Environment Policy 15 of the Isle of Man Strategic Plan.
2. Environmental Policy 15 requires that new development is sympathetic to the landscape which it would form part. It is considered the number of trees which would be lost and potentially the number of trees which would be adversely impacted upon by the development due to their close proximity would result in a development which could not be considered to be sympathetic to the landscape, and would therefore be contrary to Environmental Policy 15 of the Isle of Man Strategic Plan.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
