### Planning Application 09/01317/C - variation of condition 2 of PA 00/01498/C regarding opening hours

The said applications both relate to a premises trading as The Curry Lounge, 1, 3 and 5 Walpole Avenue, Douglas.

From examination of the said applications I note that the applicant states that it is intended to operate the premises until 11pm daily. Condition 2 of PA 00/01498/C permits the said premises to trade, 'within the period of 0800 - 1900 each day, except during TT fortnight, Grand Prix fortnight, and other public event days during July and August, when the operation may continue until midnight.'
Historically, the trading hours of such premises have not been controlled and as a result, they can remain open until the early hours of the morning. Research has shown that late-night takeaway type premises act as 'honey pots.' They cause persons to remain in the area for an inordinate period of time increasing the opportunities for criminal or anti-social behaviour.

Whilst it is noted that the applicant has not stated an intention to operate during the early hours of the morning, it is imperative that this situation does not occur by default. I would therefore recommend that a condition be placed upon any approval granted in respect of the said applications to the effect that the premises may operate between 0800hrs and 2300hrs daily (except during special event periods specified within condition 2).
