### Officer's Report

### The Site

The site lies within a small cul de sac of dwellings (four in number) which lie to the north of Arbory Road and to the west of the properties on the western side of The Crofts. The site is directly opposite anyone who would enter the cul de sac - the property faces approximately south and is a detached property with separate garage to the east. To the rear of the site is the rear of Croft House which has a long rear garden which extends past this property as to the side and rear or number 3, to the north west.

### Planning Status

The site lies within an area designated on the Castletown Local Plan of 1991 and the draft Area Plan of 2001 as Residential and just outwith Castletown's Conservation Area.

### Planning History

Since the erection of the dwelling under PA 91/1534 there have been no planning applications submitted in respect of this property.

## THE PROPOSAL

Proposed now is the erection of a sun room on the rear of the property. This will project 5.5 m from the rear of the dwelling and will be 4 m wide and the extension will be finished to match the front annex with a low stone wall, slated roof and black plastic rainwater goods.

There are trees which overhang the site from the rear of Croft House. These are shown in illustrative form only as encroaching into the area on which the sun room will be constructed.

## Representations

Department of Transport Highways and Traffic Division raises no objection to the application Department of Transport Drainage Division recommend conditions regarding the disposal of surface water from the proposed extension. The application states that rainwater will be disposed of into the existing system and this is shown separately from the foul system on the site plans. As such there is no reason to include this as a condition.

The neighbours at Croft House have been contacted and the proposals discussed. They have viewed the plans and have no objection to the application provided it is undertaken as shown and is no closer to the boundary than is shown.

### Assessment

The proposal should be judged in the light of General Policy 2 of the Strategic Plan, which states: "Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: a) is in accordance with the design brief in the Area Plan where there is such a brief; b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them; c) does not affect adversely the character of the surrounding landscape or townscape; d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses; e) does not affect adversely public views of the sea; f) incorporates where possible existing topography and landscape features, particularly trees and sod banks; g) does not affect adversely the amenity of local residents or the character of the locality; h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; i) does not have an adverse effect on road safety or traffic flows on the local highways; j)can be provided with all necessary services; k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan; I) is not on contaminated land or subject to unreasonable risk of erosion or flooding; m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and n) is designed having due regard to best practice in reducing energy consumption."

In this case the extension will not be publicly visible. The extension will however be visible from the rear garden of Croft House. The occupants thereof have no objection to the application and have indicate that they can introduce planting on their side if overlooking of the garden becomes a problem.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
