### Planning Status And Relevant Policies

Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2 and paragraph 8.12.1

### Assessment

The application site is not within a Conservation Area. The proposal involves extending the south eastern corner of the property. The proposed extension will not be visible from any public highway as the proposed works will be hidden by the existing dwellinghouse. I therefore consider the proposal will not adversely affect the visual amenities of the locality.

It should be noted that the proposed extension will have a first floor window facing towards the eastern boundary of the site. On the opposite side of the boundary is a vacant site which has planning permission for residential properties. It is therefore important to consider whether the installation of the window would adversely affect the residential amenity of the nearest dwelling. The window will be set 11.5 m away from the boundary of the boundary. There are substantial trees within the neighbouring site, which are to be protected as part of the development. Due to the separation distance of the window from the boundary and the protection of the trees, it is considered 12 October 2009

the proposal will not adversely affect the residential environment of the nearest dwelling to the application site in terms of overlooking and loss of privacy.

The notes suggested by consultees are not material planning considerations and for that reason are not attached to the report, as part of the recommendation.

I therefore recommend that planning permission be granted subject to conditions.
